This Acceptable Data Use Policy (“ADUP”) describes actions that TalentHub Holdings Limited (NZ Company Number 8132741, trading as TalentHub Partners), and its subsidiaries and affiliates (together “TalentHub”, “we”, “us”), prohibit when any party uses TalentHub’s proprietary recruitment platform or related services.

This ADUP is incorporated by reference into and governed by the TalentHub Terms of Service. Capitalised terms have the same meaning as in the Terms unless otherwise defined here.

TalentHub is committed to the responsible and lawful use of data, with particular care where artificial intelligence (AI) is applied to support recruitment, candidate advice, or market intelligence. AI is used only as a supporting tool, with decisions subject to human oversight, and personal information handled in accordance with applicable privacy and data protection laws.

Prohibited Uses of the Service

The following activities are strictly prohibited:

  1. Illegal or fraudulent activity

    • Using the Service to encourage, facilitate, or conceal unlawful, fraudulent, abusive, or harmful activities.

  2. Financial misuse

    • Using the Service in connection with credit information or financial information about individuals.

    • Using the Service for any form of debt collection.

  3. Improper background checking

    • The Service must not be used as the sole source of information for background checks or to determine eligibility for housing, employment, licences, or benefits.

    • Using the Service to determine eligibility for housing, employment, government licenses, or benefits.

  4. Political or advocacy misuse

    • Using the Service to benefit a political party, campaign, or advocacy group affiliated exclusively with a political party or campaign.

  5. Government and intelligence misuse

    • Using the Service to support national security, military, intelligence, or surveillance activities, including counter-terrorism watchlists, individual threat assessments, or mass surveillance programmes, except where explicitly required by law or regulation.

    • Providers to such agencies are also prohibited from reselling or providing access to our data for these purposes.

  6. Data protection violations

    • Using the Service in a way that violates applicable laws, including:

      • GDPR (European Union)

      • APPI (Japan)

      • PDPA (Singapore and other jurisdictions)

      • Privacy Act 1988 (Australia), including the Australian Privacy Principles (APPs)

      • Privacy Act 2020 (New Zealand)

      • Any other applicable privacy and data protection legislation.

  7. Improper handling of candidate data

    • Sharing candidate information publicly without ensuring it is appropriately sourced, relevant, anonymised where required, and compliant with applicable laws.

    • Using any data subject to GDPR, APPI, or other privacy laws except for lawful business-to-business or recruitment purposes.

  8. AI misuse

    • Using the Service to train external or consumer large language models (LLMs) or AI systems.

    • Exporting candidate CVs, resumes, or organisational data into third-party AI tools not authorised or embedded by TalentHub.

    • Misrepresenting AI-generated insights as human assessments without appropriate disclosure.
